The National Electrical Code (NEC) determines which circuit breakers are legally required in which applications — and getting it wrong means failed inspections, liability exposure, and potentially dangerous installations. This guide covers the NEC requirements that most affect procurement decisions.

What the NEC Is (and Isn't)

The National Electrical Code (NFPA 70) is a model code updated every three years by the National Fire Protection Association. It is not federal law — but it is adopted (often with local amendments) by most states and municipalities as their legal electrical code.

The current edition is NEC 2023. However, many jurisdictions are still enforcing 2020, 2017, or even older editions. Always verify which edition your jurisdiction has adopted before specifying equipment.

Ampacity and Breaker Sizing Rules (NEC 240)

NEC 240.4 requires that conductors be protected from overcurrent in accordance with their ampacity. The standard rule is that a breaker must not exceed the conductor's ampacity — but there are exceptions:

AFCI Requirements (NEC 210.12)

Arc Fault Circuit Interrupters (AFCIs) are one of the most significant additions to the NEC in recent decades. AFCI breakers detect dangerous arcing conditions that standard breakers won't respond to — preventing fires caused by damaged wiring, stapled cables, and worn insulation.

Ground Fault Circuit Interrupter (GFCI) protection has been required by the NEC for decades in locations near water. Under NEC 2023, GFCI protection is required for receptacles in:

GFCI protection can be provided by a GFCI circuit breaker (which protects the entire circuit) or by GFCI receptacles (which protect downstream outlets). GFCI breakers are typically preferred for whole-circuit protection, especially for outdoor and basement circuits.

AFCI + GFCI Combination Breakers For areas requiring both AFCI and GFCI protection (such as kitchen countertop circuits), combination AFCI/GFCI breakers are available from Square D, Eaton, and Siemens. They're more expensive ($40–$90 vs. $8–$15 for standard breakers) but simplify compliance.

Interrupting Rating Requirements (NEC 110.9)

NEC 110.9 requires that every overcurrent device have an interrupting rating sufficient for the available fault current at its point of installation. This is the AIC (Ampere Interrupting Capacity) rating.

The consequences of under-rating AIC are serious: a breaker that cannot safely interrupt available fault current can explode, causing fires, equipment damage, and injury. Most residential panels see available fault currents of 10,000A or less — standard 10kAIC breakers are fine. Industrial systems at 480V can have available fault currents of 65,000A or higher, requiring 65kAIC or higher rated breakers.

Labeling Requirements (NEC 408.4)

NEC 408.4 requires that each circuit in a panel be legibly identified as to its clear, evident, and specific purpose. This affects procurement in two ways:

Listed Equipment Requirement (NEC 110.2)

NEC 110.2 requires that all electrical equipment be acceptable to the authority having jurisdiction. In practice, this means circuit breakers must be listed by a Nationally Recognized Testing Laboratory (NRTL) — UL, ETL, CSA, etc.

Motor Circuit Requirements (NEC Article 430)

Motor branch circuit breakers follow different rules than general-purpose circuits. Inverse-time breakers (standard circuit breakers) are permitted at up to 250% of the motor's full-load current for AC motors. Instantaneous trip breakers (motor circuit protectors) are permitted at up to 1300% of FLC under certain conditions.
